Obama’s Latest Act of Genius: Pissing off the Russians, AGAIN

On Monday, President Obama signed yet another executive order, this one having to do with the Highly Enriched Uranium Agreements or “HEU”, which was signed in Washington in 1993 by Viktor Mikhailov, representing the Russian Federation, and William Burns for the United States.  This has also been referred to as the “Megatons to Megawatts” program, because it deals with Russia selling diluted and converted uranium to the United States to be recycled into low enriched uranium, or LEU. (This product is then used to produce fuel for American power plants.)  The HEU Agreement is set to expire in June of 2013, and Russia has indicated that they are not interested in renewing it; rather, they will start supplying Japan and India instead.

Now, it’s my understanding that the uranium is still being “down-blended”, but with this maneuver,  America loses a substantial piece of the money pie and our supply of LEU in one fell swoop. After all, we are facing a supply crunch on uranium globally, and this would certainly hurt our energy security. So…what do we do now? 

Obama has declared this development a ” national emergency“, written in “scary” language in both the executive order and the letter that he wrote to the Speaker of the House and the President of the Senate:

“In the Executive Order I have issued today, I find that the risk of nuclear proliferation created by the accumulation in the Russian Federation of a large volume of weapons-usable fissile material continues to constitute an unusual and extraordinary threat to the national security and foreign policy of the United States.  I therefore declared a national emergency to address this threat and to continue the blocking of all property and interests in property of the Government of the Russian Federation directly related to the implementation of the HEU Agreements.” (Barack H. As it is written, it sounds as though the United States is continuing its policy of policing the world and “protecting” assets under the guise of “threats to national security”.  According to both the letter and the E.O., the U.S. will begin to confiscate assets and property that are owned and managed by the Russian Federation : anything that deals with nuclear production, materials, or Highly Enriched Uranium.  Now, is this measure to keep other countries from calling in Russia’s debts or is it retaliation for Russia deciding to cut us out of the equation ?

This statement comes on the heels of Obama’s E.O. from March of this year, declaring that, in times of a “national emergency”, the President has complete control over the ability to confiscate and utilize U.S. assets, infrastructure, and manpower, which includes resources from private citizens.

This is nothing new…the National Emergencies Act  (50 U.S.C. 1601-1651) was enacted in 1976 in order to prevent the president from abusing this power and extending a state of emergency indefinitely. When the National Emergencies Act was put in place, it actually didn’t cancel out the states of emergency that were called in 1933 ,1950,1970, and 1971, so it could be said that we have a perpetual crisis in America. Since the Clinton administration, “national emergencies” have been arbitrarily declared and extended to hold on to that power, under the specter of terrorism. The U.S. is already under a state of emergency currently and has been since 9/14/2011; so this is just another extension.

So, why the declaration of a “national emergency” now? I think that there are some pretty solid answers to that question, and you may not like them.

What Obama is doing with this E.O. is smart, really, even though it’s despicable. He is effectively giving himself the power to sanction Russia as a “threat to national security” and freeze any assets under U.S. jurisdiction.

Combine this with the National Defense Resources Preparedness E.O. that was signed in March, and this becomes a sticky situation.

The NDRP was first introduced in the 30’s, and has been “updated” by almost all of the presidents since then. The major problem with the NDRP is that it puts the federal government above the rule of law and allows preparation for war by giving the President the power to take control of all civil energy supplies, including natural gas and oil and to restrict or control civil transportation, which is dependent upon oil.

At least two constitutional rights are subject to revocation during a state of emergency:

The right of habeas corpus, under Article 1, Section 9;

The right to a grand jury for members of the National Guard when in actual service, under Fifth Amendment.

There is a provision for drafting American citizens into the military to fulfill “labor requirements” in the name of national defense: WITHOUT CONGRESSIONAL OVERSIGHT.

  Now, most of Obama’s update had to with shifting the power from FEMA to the Department of Homeland Security. Unfortunately, the DHS is not the top performer when it comes to preserving civil liberties, which we are reminded of every time the TSA does something stupid.

Regrettably, this newest E.O. on Russia comes at a time when Americans are already concerned that another foreign war is looming. With the NDAA 2013 authorizing military action against Iran, the seemingly endless war in Afghanistan, and the unrest in Syria; it looks like we are purposely antagonizing yet another country.

At the same time, we are set to begin imposing further economic and travel sanctions against Russian officials, though some have been in place since 2011. On Tuesday, the  U.S. Senate Foreign Relations Committee unanimously passed the “Sergei Magnitsky Rule of Law Accountability Act,” sponsored by U.S. Democratic Senator Benjamin Cardin . This bill would impose visa bans and asset freezes on Russians that the U.S. accuses of human rights violations. With an already strained relationship due to the E.O. and the current legislation, Russia is very upset.

Relations were further strained when the Obama administration blocked Tehran from the U.N. meeting that takes place on Saturday, citing Iran’s involvement in the Syrian conflict.  There has been talk that the administration will condition U.S. participation in the Geneva talks upon Russia endorsing the demand that President Bashar Assad step down: a position that Moscow completely rejects, saying that it is not their right to exercise outside authority to determine who will rule Syria.

While we concentrate on the Middle East, Russia may be coming up with a plan of their own.  Things are certainly coming to a head, but where will the most violent reaction come from?

    Very good blog article Angie. Lots of info concerning a confusing circumstance (everything O does is confusion).

    • Thanks. It actually took almost a whole afternoon of research to actually figure it out. The E.O. is written as a “protective” role, but it actually opens the door for further sanctions.
